When Is Arbitration Better than Litigation?
Arbitration is an organized legal procedure in which disputes are submitted to an arbitrator or panel instead of the formal courts, ending with a binding decision enforceable as a court judgment. Arbitration is preferred in commercial and international disputes because it is faster, guarantees confidentiality, and allows selection of an arbitrator specialized in the dispute subject matter.
Arbitration becomes mandatory when the contract contains an explicit arbitration clause — failure to resort to it in such cases exposes the lawsuit to procedural rejection by the court.
Jordanian Legal Framework for Arbitration
- Jordanian Arbitration Law No. 31/2001 — governs domestic and international arbitration and sets its procedures.
- Civil Procedure Law — governs judicial enforcement of arbitration awards.
- New York Convention 1958 (acceded to by Jordan) — for enforcing international arbitration awards.
