Khul' is a fundamental legal right of Muslim women under Jordan's Personal Status Law No. 36 of 2010. Many women are unaware of their full rights or fear that proceedings are long and exhausting.

What is Khul'?

Khul' is the right of a woman to dissolve her marriage in exchange for returning her dower (mahr) to her husband, without requiring his consent.

Conditions for Acceptance

  • The claimant must be a Muslim wife under a valid marriage.
  • Proof that continuation of married life is impossible (moral harm is sufficient).
  • Return of the received advance dower, which the court may reduce in proven harm cases.

Effect on Children

A khul' ruling does not affect children's custody and maintenance rights. The mother retains custody rights and the father remains liable for child support.
