Inheritance in Jordanian Law — Rules and Estate Settlement Procedures
Overview
Inheritance in Jordan is governed by Personal Status Law No. 36 of 2010, applying primarily Hanafi jurisprudence. Sharia courts have jurisdiction.
Heirs and Shares
- Wife: 1/4 (no children), 1/8 (with children).
- Husband: 1/2 (no children), 1/4 (with children).
- Daughter: 1/2 (alone), 2/3 (two or more).
- Residuary heirs take the remainder after fixed shares.
Estate Settlement
Procedure: death certificate → court heirship document (hijja) → estate valuation → debt settlement → distribution by agreement or court order.
Wills
Wills are valid for non-heirs up to one-third of the estate. Wills to heirs are void unless approved by other heirs after death.
