Contracts in Jordan are governed by the Civil Code No. 43 of 1976, derived from Islamic jurisprudence and Egyptian/French civil law.

Contract Elements

  1. Legal capacity of parties.
  2. Mutual consent free from defects (mistake, fraud, duress, gross unfairness).
  3. Lawful and determinable subject matter.
  4. Lawful cause.

Voidable Contracts

Contracts tainted by mistake, fraud, duress, or gross unfairness are voidable by the affected party.

Breach Remedies

Specific performance, contract rescission with compensation, and right of retention.
